Bitcoin Insights ("the Service") is an educational content and software product. It is not:
- investment advice, financial advice, tax advice, or legal advice;
- a recommendation to buy, sell, hold, lend, borrow against, or take a leveraged position in any crypto-asset;
- portfolio management, brokerage, custody, or any other regulated crypto-asset service;
- provided by a licensed investment advisor, financial advisor, or Crypto-Asset Service Provider (CASP) authorised under Regulation (EU) 2023/1114 (MiCA).
Everything in the Service - including the Strategy pages, the Portfolio Simulator, the "My Portfolio" tool, and the AI Assistant - is general, non-personalized educational content, structured around a publicly described framework. Nothing in the Service is prepared with regard to your individual financial circumstances, and nothing constitutes a personal recommendation within the meaning of applicable financial-services law.
You are solely responsible for your own investment decisions. Bitcoin and crypto-assets are highly volatile. Lending and futures strategies described in the Framework carry risk of total loss of capital, including amounts beyond your initial deposit in the case of leveraged positions. Never commit capital you cannot afford to lose.
1. Who we are
The Service is provided by Damian Michalski ("we", "the Operator"). Contact: contact@bitcoininsightsframework.com.
2. Acceptance of these Terms
By purchasing, accessing, or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into this agreement, and accept these Terms of Use in full. If you do not agree, do not use the Service.
3. What you get
A one-time purchase grants you a personal, non-exclusive, non-transferable, revocable licence to access:
- The Strategy - educational content describing a four-element framework (strategic accumulation, lending, futures, rotation) for managing a Bitcoin position across market cycles;
- Portfolio Simulator - a calculator that computes hypothetical outcomes based on numbers you enter. All outputs are illustrative, use figures you control, and ignore funding rates, interest, slippage, and fees unless stated;
- My Portfolio - a personal record you can optionally save, allowing the AI Assistant to reference figures you have entered;
- AI Assistant - an AI-generated conversational tool (see Section 6) subject to a monthly message allowance stated in-product;
Your licence permits activation on a limited number of browser profiles, as stated in-product. Activation is tied to a browser-based identifier stored locally in your browser; using a different browser or device, or clearing your browser data, generates a new activation and counts toward this limit. If you reach the limit through ordinary use (for example, switching devices or clearing your browser data), contact us at contact@bitcoininsightsframework.com and we will reset your activations.
for your personal, non-commercial use only. You may not resell, sublicense, redistribute, or use the Service to build a competing product.
4. Price, payment, and access
- The price shown at checkout (including any Early Bird discount, subject to the stated unit cap) is a one-time payment. There are no recurring subscription fees for the core product.
- Purchases are processed by Gumroad, Inc. ("Gumroad"), which acts as the authorised reseller and merchant of record for this transaction. This means your purchase contract for the payment itself is with Gumroad, not directly with the Operator; Gumroad calculates, collects, and remits applicable VAT/sales tax on your purchase, issues your payment receipt, and handles payment-card processing. Gumroad's own terms of service and refund mechanics (accessible at gumroad.com) apply to the payment transaction itself, alongside these Terms, which govern your use of the Service once access is granted.
- Prices shown on our site are exclusive of tax; Gumroad adds applicable VAT/sales tax at checkout based on your location.
- Access is granted upon successful payment confirmation via Gumroad, typically activated via the "Already purchased? Activate Access" flow.
- Refund requests relating to the payment itself should be raised with Gumroad in the first instance; refund requests relating to the Service's content or functionality (Section 5) may be directed to us at contact@bitcoininsightsframework.com.
5. Right of withdrawal (EU/EEA consumers)
If you are a consumer located in the EU/EEA, you generally have a 14-day right to withdraw from a distance purchase without giving a reason, under Directive 2011/83/EU (as implemented in Poland by the Consumer Rights Act).
However, because the Service is digital content not supplied on a tangible medium, this right is lost once performance has begun if you have (a) given your prior express consent to immediate access, and (b) acknowledged that you thereby lose your right of withdrawal. By ticking the consent box at checkout, you provide this consent and acknowledgment.
If you have not yet accessed the paid content (Strategy detail pages, Simulator save function, AI Assistant, My Portfolio), you may request a full refund within 14 days of purchase by contacting contact@bitcoininsightsframework.com.
6. The AI Assistant - specific terms
- The AI Assistant is an artificial-intelligence system. You are interacting with AI, not a human advisor.
- Responses are generated using a large language model with web-search capability. Web-sourced information may be incomplete, outdated, or inaccurate, including cited market data, prices, and attributed statements. We do not independently verify each response before it is shown to you.
- Responses reflect the Framework's general logic applied to publicly available market information and, where you have saved one, the figures in your My Portfolio record. They are not a personal recommendation. The Assistant does not know your full financial situation, other holdings, obligations, risk tolerance beyond the label you selected, or objectives, and cannot take these into account in the way a licensed advisor would.
- Your account is subject to a monthly message allowance, as shown in-product. We may adjust this allowance, rate-limit usage, or suspend the Assistant's availability (in whole or in part) at our discretion, including for cost-management or abuse-prevention reasons.
- Do not submit sensitive personal data (national ID numbers, full account credentials, exchange API keys, etc.) into the AI Assistant chat.
7. No advisory or fiduciary relationship
Nothing in the Service creates an advisory, fiduciary, brokerage, or agency relationship between you and the Operator. The Operator does not manage your assets, does not have access to or control over your exchange accounts or wallets, and does not execute, recommend the execution of, or facilitate any specific transaction on your behalf.
8. Risk disclosure
Crypto-assets, including Bitcoin, are highly volatile and may lose some or all of their value. Strategies described in the Framework - including collateralised lending and leveraged futures - carry material risk, including:
- liquidation risk: posting Bitcoin as loan collateral or futures margin can result in forced liquidation and permanent loss of the pledged assets if prices move against your position;
- leverage risk: futures leverage amplifies both gains and losses and can result in losses exceeding your initial margin;
- counterparty and platform risk: lending platforms and exchanges may become insolvent, be hacked, restrict withdrawals, or cease operating, including as a result of ongoing regulatory transitions (e.g. MiCA CASP authorisation) affecting which platforms may legally serve EU customers;
- tax and regulatory risk: the tax and legal treatment of crypto-asset lending, borrowing, and derivatives varies by jurisdiction and may change. You are responsible for your own tax and legal compliance.
Past performance and illustrative historical examples shown in the Framework (including any worked example of capital growth across a market cycle) are not indicative of future results and are shown for educational illustration only.
9. Intellectual property
All content, design, code, text, and branding of the Service are owned by the Operator or its licensors and protected by copyright and other intellectual-property laws. Your licence under Section 3 does not transfer any ownership rights.
10. Data protection
Your personal data is processed in accordance with our Privacy Policy, in compliance with the GDPR. My Portfolio data (capital, allocation figures, notes) is personal data associated with your account; do not enter data about third parties.
11. Limitation of liability
To the maximum extent permitted by applicable law:
- the Service is provided "as is" and "as available", without warranties of accuracy, completeness, or fitness for a particular purpose;
- the Operator is not liable for any trading, investment, or financial losses arising from your use of, or reliance on, the Strategy content, Simulator outputs, or AI Assistant responses;
- the Operator's total liability arising from or related to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
Nothing in these Terms excludes liability that cannot be excluded under mandatory Polish or EU consumer-protection law, including liability for intentional misconduct or gross negligence, or statutory warranty rights (rękojmia) available to consumers.
12. Termination
We may suspend or terminate your access if you breach these Terms, misuse the Service (including attempts to circumvent usage limits or extract the underlying prompts/models), or engage in fraudulent payment activity. You may stop using the Service at any time; this does not entitle you to a refund except as set out in Section 5.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after the effective date of an update constitutes acceptance.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Poland, without prejudice to any mandatory consumer-protection provisions of the country in which you reside. Any dispute shall be subject to the exclusive jurisdiction of the courts having jurisdiction over the Operator's registered seat, unless mandatory consumer law grants you the right to bring proceedings elsewhere. EU consumers may also use the EU's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
